1. Hosting

SAS Moby View , Simplified Stock Company with capital of € 585,000 registered office located at 59 rue de Ponthieu - 75008 Paris (France), registered with the RCS of Paris, under number  499 947 422, is the publisher of the website www.mobyview.com (the “Website”)

The publishing Director is Samy ELBAZ, CEO of SAS Moby View.

The Web site is hosted by the following company:

Amazon Web Services EMEA SARL
5 rue Plaetis,
Luxembourg, L-2338, Luxembourg

and it is hosted on Amazon's Paris Data Center.

2. Intellectual Property

The Publisher holds the intellectual property rights over all elements of the Website (text, images, tree structure, distinctive signs, graphics, visuals, software, photographs, drawings, models, logos and brands, etc…). In the absence of the prior written consent from SAS Moby View, it is strictly forbidden to create any reproduction, representation, adaptation, translation, modification, denaturation or transfer of any element or data comprising the Website.

Any violation of the foregoing provisions constitutes an act of infringement liable to incur the civil and/or criminal liability of its author.

Conversely, SAS Moby View holds the intellectual property rights over all software elements & components making up the MobyView platform ("The Platfrom"), enabling the creation and build of native mobile apps and which the Website gives access for strict demonstration purposes.

 

3. Terms of use

3.1   The Website alllows the user through a sign-up procedure to request access to the MobyView platform for a trial purpose.

3.2   After signing-up, the user will obtain credentials to the MobyView platform for the sole purpose of trying it out.

3.3   These credentials do not constitute in any shape and form contractual terms between SAS Moby View and the user.

3.4   As contractual agreement will intervene upon terms mutually agreed by both parties when the user would be ready to publish a mobile app by means of the MobyView platform.

 

4. Privacy Policy

As part of the forms for download and contact on the www.mobyview.com website (the “Website”) and your navigation on the Website, the company SAS Moby View (SIREN:  499 947 422 RCS PARIS), as controller, collects personal data about you (last name, first name, position, company, phone number, e-mail address and information saved by means of cookies). This data will be processed by our France-based Sales team.

By completing one of these forms, you consent to the inclusion of your personal data in the SAS Moby View prospect & contact  database hosted within the European Union. The collection of personal data by SAS Moby View is necessary in order to (i) follow-up on the commercial relationship with users, (ii) respond to requests for information from users, (iii) generate Website visit statistics, (iv) provide access to the MobyView platform that enables the creation of native mobile apps, and (v) subject to your explicit consent, be used for the purpose of contacting you for a future event organized by SAS Moby View, to send you a newsletter or a commercial request related to your sector of activity. The processing of your personal data is based on your express consent collected during the referral of information about you.

Your data may be communicated to any potential buyer of our business. Your data is also transmitted to our partner in charge of maintaining a management tool for the customer/prospect database and to our service provider in charge of hosting the data. We are committed to selecting our partners by applying the best security standards.

Given the nature of the data and the risks existing as a result of its processing, SAS Moby View undertakes to take all necessary precautions to preserve its security, and in particular to prevent it from being distorted, damaged, or that unauthorized third parties gain access.

Your personal data will be kept for a maximum of 3 years after its collection, or from our last contact from you if applicable (for prospects), or from the end of the business relationship with you (for customers).

In accordance with law n° 78-17 of January 6th, 1978 relating to data processing, files and liberties, as well as European Regulation of April 27th, 2016 on the Protection of Personal Data, you have the right:

  • to obtain communication and a copy of the personal data concerning you
  • to oppose the processing of your personal data
  • to request access to your personal data, as well as its correction or deletion
  • to request the portability of data concerning you and subject to automated processing by InsideBoard
  • to request limitation of the treatment of your personal data
  • to arrange the fate of your data after your death
  • to file a complaint with your country’s supervisory authority to challenge the data processing practices of InsideBoard
